If neither parties in a marriage doesn't make a WILL regards their property, savings, etc and only one of them dies - does everything go straight to the wife/husband? Even when a mortgage is already paid off?

I'm sorry to hear that ...WILLs are such tension discussions.

I don't want to dwindle his kids out of anything but they will gain twice inheritance wise from their Dads property then their Mums property, whereas my children only gain from this property!!

Arghhhhh! Hate it all - feel like not writing one!
but who knows really? it could be years before the mum dies, and she may have sold the house for a round the world cuise by then.
it's not impossible, but unlikely both you and partner will die together - if you die forst, he can then do whatever he likes anyway (and i guess if you are dead, he'll distibute it evenly). If he dies first, you can always just leave it you YOUR kids, not his

Have you considered that if you and your husband dies before you and has left his share of the house to the children They could force a sale and you would be homeless? We both made wills leaving everything to each other and then to be equally shared between all the children (his and mine)
