I had to take mine the other day back to the shop as it was inoperable as there was a problem with the software which the man at the shop said was a regular fault, so they sent it away leaving me without a phone (Though I used my old one) now my question is should they be paying me compensation in anyway through breach of contract seeing that I'm paying them monthly for a working service and I was not given that service? Any chance of me getting a month payment break or something?

Is it costing you more using your old one?
are you still paying the monthly fee? are you still using the service, just through another handset?

if you are having to use another phone and another service such as payg or somehting then you should get a discount for the days you are not able to use their service, but it depends on how long you are without...a few days an itd be buttons, but weeks or months more
