My brother who is 26yrs was sharing a house with his girlfriend of 18 months, about 3 months ago, her brother who was 15 at the time moved in with them as he'd been thrown out of his parents house (he lived with his mother and step-father), they said they couldn't handle him any more. His sis and my bro took him in as they felt sorry for him having nowhere else to go. He had recently turned 16 and he is a "typical" teenager, being lippy to both, pushing his luck to the limit on most things, he bunks off school, smokes and basically is a bit of a s*d. His sister (who is 22) became his legal guardian when he moved into their house. However, last night my brother basically had had enough; he had an argument with his girlfriends brother which got a bit out of hand and my brother ended up giving him a little slap (nothing major). Her brother called the police and is now having my brother up for assault and he insists he is going ahead and pressing the charges. My brother was arrested last night and held by police for questionning until 2am this morning when they released him, it will be going to court in a couple of months I think. My brothers girlfriend is now sticking up for her brother (as blood is thicker than water i suppose?!) but she always used to have a go at her own brother and even threatening to throw him out in the last couple of months, herself. I cannot understand what is going on. My brother insists he is now leaving her and moved back with my mum. What will happen do you think? Will the police/courts be harse in this instance, he has never assaulted anyone before and now the boy is 16 I'm not sure if they still class him as a minor? My brother has been away before but only for a car offence, would this be taken into consideration although it is not related in anyway?

when you say your brother "was taken away for a car offence " , was it a minor motoring offeence......if he was driving while disq.......this wont mean much , but if he used criminal damage on a vehicle/or take drive away this will be pointed out.......... i dont think your brother will get anything more than community service , if he is convicted of assault ....... he maybe bound over to keep the peace, if he pleads guilty...in which case , no community sevice maybe dished out if "he is bound over to keep the peace " ......
