private eye tried this as a defence 30 or so y ago - we cant libel him, he has not reputation. Judge didnt wear it.

Thats what annoys me Douglas.  In cases like this where there is no doubt, i.e. he refused the test (pretty black and white), he should have been marched out the door right there and then.
