because the NCB - either nationally or divisionally - had no policy for the management of waste tips. plus the spring that emerged from the bottom of the tip and brought about its eventual collapse had been known about for years, despite Lord Robens' assurances to the contrary. the NUM and Merthyr Council were both exonerated at the inquiry for not pursuing their concerns about the tip, because there was no action they could take in the face of assertions from NCB that the tip was safe.

seeing officials lie under oath
