Okay. My wife left me 6 months ago and during that time she has filed for divorce. I accepted (couldn't be bothered with the hassle etc) and now waiting for it to come back from the courts.

My children (9&12) are living with me. She hasn't seen them in the 6 months. Both do not want to be associated with her anymore. The child tax credits etc are all sent to me under my name only. Schools, Docs and dentist and family are minutes away from our family home.

What chance does she have if she goes to court to gain custody please?

Not a lot, I would think. Your children are of an age to make their preferences known and this will weigh heavily with the court.

They are bitterly disappointed in her lack of interest as her new B/F is more important than them. Their hatred (their words) for her is getting stronger by the day. She says she can't afford paying towards one of their gym fees (£26)!!
In that case why should she want to seek custody? I think you have nothing to fear going on what you have said so far.

I think a custody hearing is inevitable since children are involved
clearly you dont want to leave it to her - you should turn up
I am not sure if you need a lawyer ( saves money )
and the criteria are ( only ) the interests of the children are paramount....

If she hasn't seen them in 6 months and doesn't pay maintenance the chances of her even taking you to court is pretty slim.

Thank you for your answers so far.

She moved into her flat back in early June and has not even bothered telling me (or if she doesn't want me to know) or the girls her new home address or that she has a B/F! Shocking and very sad behaviour from her. Dropped all responsibilities as a Mother and home owner.
