Is this rape ? The learned judge thinks not.

how can it possibly be rape? Doesn't matter what porkies he told, she consented, end of.
Of course it's not rape, she agreed to sex, albeit under a lie, but she still agreed.
And personally speaking. I wouldn't trust any man that said he was sterile, I'd take care of my own birth control responsibilities, just as men shouldn't always believe women when they say they're on the pill (would that be rape?)

A girl was found guilty of rape even though it was consensual because she pretended to be a boy. This is surely the same sort of thing. I am sure a man was also found guilty of rape because he promised to use a condom but didn't.
I am slightly horrified that women are consenting to sex with casual hook ups without insisting on a condom

As far as I am aware, if a man invades a woman's body against her consent, that is violence. It doesn't mean he has to hit her over the head for it to be violent.
A-H, your definition of 'violence' is fine, it just doesn't fit with the legal definition of 'rape'. You asserted what 'rape' is - and it wasn't accurate.
15.47 In principle I agree women should not be trusted, but what about long standing relationships, not to mention within marriage ? Women have full control over their fertility and therefore strictly speaking choose when to become pregnant. "Accidents" are no accident and deliberate manipulation is well known to take place. If theft occurs from an unlocked house only the insurers put responsibility on the owner, the law/courts still classify the action as theft and against the law. The law does not (I think) cover the imposition of fatherhood against his stated and well known will (is that rape ?) but the sense that morally the action is wrong has followers among all those who ended up with unwanted pregnancy and a lifetime of unhappiness, often including the resulting child (at least in terms of adverse effects on its life). Saying he should have kept it in his pants is a cheap dismissal of the reality of seriously selfish betrayal of trust (when he and she were agreed as "not intending").
I have a feeling we may have had this discussion before, but men also have full control over their fertility, and whether it is a woman imposing father hood on a man, or a man imposing mother hood on a woman, it could all be avoided if both parties exercised that control

Rape is a forced act, not a misled one.
Lady CG, rape does not have to be forced.
No it's not. It was still consensual. Someone tells you that they are infertile one must consider the possibility of them being mistaken, or lying. Can't make important decisions assuming all is as it seems. The question is whether you want relations or not.
