Yet another one falsely accused, and evidence held back by the Police and yet she enjoys anonymity whilst his reputation is tarnished forever (You will always get the idiotic no smoke no fire brigade)

Heads need to start rolling.

that's the trouble, this can have devastating effects on those women who have a genuine case.
TTT, just to say that I agree that this looks more like it is intentional rather than just incompetent.
It strikes me there are three issues:-

1) People (not just women) deliberately lying to further their own malicious end. They should be charged and prosecuted and their trials public.
2) Failed rape prosecutions where the Crown have failed to prove "beyond reasonable doubt". It does not follow that the victim has lied. The victims in those cases should have their anonymity preserved.
3) Police officers who do not do a proper job of reviewing the evidence. They are under a duty to disclose evidence that might assist the defence or undermine the prosecution case. This is not a new problem. I havent done any criminal work for a very long time and it happened then as it is still happening now. It should be picked up at the very latest when the Crown Prosecutor reviews the evidence. Sadly the CPS funding has been cut to the extent that they are struggling under the weight. I recall reading recently that a Judge said that the criminal justice system is "not fit for purpose" at the moment with the massive cuts. I have to say this type of case leads to the view he is right.
I know of a woman who was prosecuted, imprisoned (and named) for false rape allegations.
She'd done it 5 or 6 times, mind.
Mikey - I think you'll find none of us 'need the wisdom of New Judge' to hold, or voice, a valid sensible, logical opinion on this sort of matter....

I think this sort of behaviour on the part of the police/CPS is a consequence of Performance Related Pay. You see it happening with eg, Traffic Wardens being over-zealous when they have to book so-many people, delivery drivers driving like loonies etc; if you promote police on number of prosecutions there is always going to be a tendency for them to massage the evidence.

I can't quite see how it's a breach of the peace and I didn't think bullying was a criminal offence.
If such a woman (or man) is prosecuted for perjury, wasting police time and any other offences committed whilst lying to the police and the court then she (or he) will not be given anonymity, and that is the correct course of action.
Exactly - and we don't need NJ to tell us that.
Lets hope this poor chap has his day in court, and his accuser is put away for a long time, as an example to others, if no other reason.

allegations to the police are immune from civil suit
that is you cant sue for libel. Not sure about malicious falshood. - as a judge said - virtually every allegation made to the polcie is libellous if untrue and no one wants to limit complaints. Perjury is certainly not actionable in a civil court - but is still a crime.

that leaves - witness offences - perverting the course of justice (1) , perjury ( only used if perjured evidence has led to a wrong conviction ) and er a third one
( I am not paid to know this stuff ) - wasting police time perhaps

and you know they conceive that they have better things to do.

The important question to answer in my mind is this -

Is there a deliberate and systematic effort by the police and CPS not to disclose evidence to the defence lawyers - not just in alleged rape cases - but other types of crimes as well - in order to increase the conviction figures .

If not , why is the evidence not been disclosed in a large number of cases ?
Is it a matter of resource in wading through the increased traffic / documentation .

In either case is correct , it is truly unforgivable that people are been wrongly convicted for something of which they are innocent .

Maybe employing a humourless, ill-tempered Irishman, a fragrant English rose and a wee wummin in a wheel chair would get better results.
They fairly whizz through red herrings and nefarious doings as a matter of course.
In fact

That may be where modern plod get their ideas on procedure and timescale. If it can't be solved in two hours despite ultra diverse characters, no matter how unlikely, then it's well nigh impossible and should be shelved.
