i have just been hit from behind by another car the driver said to me sorry i lost concentration, when i got home to get my details to send to other party i looked and my mot had expired by 7 days am i still insured???

You would claim from the person who hit you, anyway, but you need to contact your insurance company straight away. This post from another site suggests that you are invalidating your insurance by having no MOT and can therefore be in trouble yourself for driving without insurance http://uk.answers.yah...20090109234850AAUPuFV

I think you were lucky doc - each time we've been shunted we've had to produce our documents.
Couldn't you say you were on your way to get it MOT'd??

(I know it's the wrong thing to say)
That's the only time it's valid to drive without a MoT - if you are on your way to get it done.

No, it will not affect your insurance.
Yes, the information from the other site is incorrect.

This matter has been raised many times before on AB (can't be bothered to look for the questions). An insurer cannot invalidate the compulsory element of your insurance cover because of the commission of another offence, with the exception of a person driving whilst disqualified from holding or obtaining a licence.

If they could, every motoring offence prosecuted such as no MoT, faulty lights, speeding, careless driving, no tax etc etc would be accompanied by the far more serious offence of No Insurance. And a vist to your local Magistrates' Court on traffic day will show you that this is not the case.

Yes, your insurance will still be valid.

Yes, you can still claim from the Third Party's insurers (or more specifically, your claim will be against the Third Party himself. It is up to him to decide where he gets the money from or whether he will leave it to his insurers to deal with). Whether or not your insurance is valid is irrelevant to this question.
