im been charged with gbh and sec 39 beating..... i was in my local with my girlfrind it was late and we came out about 6pm at 10 pm we went into a pub and at the bar was the landlady and her daughter they dont like my girlfriend and they had been drinking all day about 15 pints each also her husband who is the manager........as we was sat at the bar i seen that they was looking over but i didnt say out at the time but i then kissed my girlfriend and picked her up and cuddled her with that the landlay sadi get a room we dont give sex in here? i thought sh was joking but kind of not ...we started arguing with the four of us then her husband came into the pub as i was saying that his wife had started on us forno reason and that we was ment to be doning sex acts but it was a kiss the next thing is everyone is pushing everyone and then the manager grabbed me from behind i didnt do out and then his wife hit me in the face while he held me the next thing is everyone got more involved and his wife came bk at me and push us all on the floor which resulted in her husband getting a broken leg! but she shouted out that i stamped on him and hed butted her...........i have assault on a police man 4 yrs ago for pushing him does anyone have an idea what i might get.....i would like to point out that they was all in drink and got kicked out of the pub next door for been to drunk just be for we came in. also the people that made statements no of them ha said they did see me puch or kick anyone only that they heard her shout it all.only an ex worker of the pub has said she seen me head butter but this is a lie and ive been told she told her to say it also they wont show the cctv !!!!! i wounder why?

Firstly, the courts never regard being drunk as being an excuse or justification for an offence. Exactly the opposite applies; i.e. your drunkenness will make things far worse for you.

The sentences for Section 20 offences shown on page 15 of this document refer to first-time offenders (facing a single charge of assault) convicted after a trial:

If you're convicted, your previous offence (and the additional Section 39 charge) will push the sentencing range higher. You're probably looking at a sentence of around 9 months custody.

have I just read this right? (it was hard!)

Are you saying that the landlady and the manager of one pub had just been kicked out from another pub next door for being too drunk yet were working the bar?

If they were "on duty" so to speak then I'd be making a complaint to the owners of the pub (the brewery) and to your local councils licensing people if what you say is true.

It won't help or change your criminal case, but if they were really that drunk in charge of a licensed premises they need to be reported!

i wasnt drunk......the landlady and landlord or managers if you want to call them that. they had been out all day at rugby and came bk to the pub about 7ish but then went next door to another pub and then got kicked out for been to drunk and walking off with the pints...........i was in there pub at 10ish when they was in the pub that they run...... the reason that her husband wasnt in when i was because he was next door saying sorry and taking the glasses back. it was their day off but under the licensing policy even on a day off they carnt be drunk nor drink over a set amount ive been told.....the only thing im guilty of is standing by my girlfriend and wanting to know what the landladys problem was yeah i shouted and yeah i might of look agressive but i never hit or stamped on anyone also ive seen the doctors statement showing that they wasnt any blood or a cut on her nose nor in his opinion any sigh of a blow or hit to her nose or forehead

yeah i have but its off to crown court so ill be getting a barrister.........the solicitor said that he can see it been kicked out on the lack of evidence but he carnt be 100 % until the only person that can be or push for it to be kicked out is my barrister........................but she also said shes seen people get time for nothing and people walk free when they shouldnt of so we will see..................... ill know more next week when i see my barrister before my court plee date
Did this incident occur on the same night as the incident in a pub that led to a charge of criminal damage?
