In defence of Trump’s latest indictment, his lawyers best arguments are that the things he said (about over-throwing the 2020 election result) are part of free speech, protected under first amendment rights, and that his lawyers gave him the advice.

One of the many problems with this defence (besides it being complete nonsense in terms of what Trump is alleged to have said & done), is that Trump would have to testify, and even Bill Barr (Trump’s appointed United States Attorney General) thinks that would be a very bad idea (for Trump to testify).

The trial judge is looking for the trial to begin early next year, so maybe Trump will be campaigning from his prison cell to gain the Republic Party candidate and then president of the USA. There is nothing in the US constitution preventing someone in jail from holding the office of president.

This youtube video includes a damning CNN interview with Bill Barr (giving his thoughts on this latest indictment), interestingly he refused to say whether he (Bill Barr) had been interviewed by Special Council (Jack Smith).

It would be very very unwise for Trump's counsel to let him testify in his own defence.

In exactly the same was as Prince Andrew's laywers managed to keep him away from the US investigators - but sadly not Emily Maitliss - Trump would condemn himself out of his own mouth by being utterly immune to the simple concept of shutting up and not putting his foot in it.

I would love to hear him 'defend' himself, it would make excellent television.
Apparently he wants one of his trials moved from Washington to West Virginia.
He claims he wouldn't get a fair trial in Washington. A jury in W Virginia would be more to his liking.

Or perhaps he'd simply prefer an unbiased jury, prepared to judge the matter solely on the evidence they are presented with.

West Virginia is a state with a population that is more than 90% white. I'd guess the Trump cult would be very strong there. To find a jury which would listen to the evidence and return an unbiased verdict might be difficult.

CNN has a Trump lawyer on (John Lauro) arguing that the things Trump said and did in relation to attempting to over-throw the 2020 election result were ‘aspirational’ and in no way ‘conspirital’ or ‘an attempt at fraud’.
