Abandoned Goods

A legal opinion, please :

We have recently completed a bathroom refurbishment - the plumbers merchant supplying the sanitary ware have been a nightmare to deal with (late delivery, incorrect and/or damaged goods, etc).

At the end of the job there are €350 worth of incorrectly delivered goods stuck in our hall. We've had a full refund for this stuff and requested the company to collect their property. Despite me making two phone calls to remind them and then sending an email, they have failed to even arrange the collection, let alone actually pick up the items.

We have visitors arriving next week, and gness really doesn't want a spare toilet in the hall to welcome them.

Can I just send another email giving an ultimatum that we will regard the goods as being abandoned if not collected by [insert date here] and then either sell or give away the unwanted goods?

What other options do we have?

Thanks

do you have outside space - you could stick them outside under a tarp.

We have plenty of space - but the wild weather here tends to leave sheets/tarps in the next county fairly soon after deployment ... and I don't want an al fresco toilet facility on display either - the neighbours think we're weird enough already ...
Just start invoicing them for storage costs.

Yes - that's a nice idea, TTT :)
Does Irish law allow you to do that?
Would you care to enlighten us as to the name of the plumbers' Merchant? Just a hint would do as we are looking to update our bathroom and you might help us to avoid problems.

They're a local firm in Killarney, bhg
Thanks Dave - I'm safe then.
or help BHG get some extra stuff for free :)
Can't you put it in your boot and bring it round to their yard
No they are not abandoned
( sozza is this Law, where the law of the land is discussed or some joke forum like Chatterbank?)
the title still resides in J Crapper.

Tell them to collect

I would send a letter ( perhaps c proof of posting - an extra 6d)

I dont think these are unsolicited goods - you er sort of solicited them.

You do NOT wish to tell a judge - " I got rid of them, because my wife is shy and did not wish to pee in front of an unplugged in lavatory pan which was looking at her|"
I have said some stupid things to judges but never that

Nope, Baz - a 120km round trip and I doubt the boot's big enough for everything - plus they been absolute [redacted] the whole way through and I'm not doing any of the heavy lifting on this.
Does Irish law allow you to do that?

erm I think he is asking US that
use the toilet as a garden planter

Hmmm - I sort of expected that answer, PP - very annoying, but I'll just have to keep plugging away until they send a van, I suppose.
arguably, dave didn't solicit the wrongly delivered goods, only the right ones.
TORATORATORA made the suggestion so perhaps he can supply a link to back it up?
i think to send an invoice you would need to be a registered company
Ok - when you said 'local' - i thought you meant 'local ' :-)
Where we live, Baz that is local. :-)
