Hi there, my wife has been given a letter saying that her company is going to open redundancy talks with her ( and everyone else) commencing next week and is expected to take 30 days. the letter also says that it is not a notice that she is going to be made redundant, the question is that after the 30 day consultation period and my wife is indeed made redundant is she entitled to be given one months notice from that date?

It depends upon the length of employment

"Notice periods

You must be given a notice period before your employment ends.

The statutory redundancy notice periods are:

at least one week’s notice if employed between one month and 2 years

one week’s notice for each year if employed between 2 and 12 years

12 weeks’ notice if employed for 12 years or more

Check your contract. Your employer may give you more than the statutory minimum, but they cannot give you less."

She has been with them since 2008 and is monthly paid, the query really was does the notice period start after the consultation period?
As the letter states, it's not a notice of redundancy so the notice period begins when the letter notifying the redundancy has been issued.

Thank you
If they want her to go immediately when the decision is made, they then have to add pay in lieu of notice to the payout.
Question Author
Thank you both, yes Hopkirk having re read the letter again that is indeed mentioned at the bottom of the letter
Twelve weeks notice, unless her contract gives more.
Plus any outstanding holiday pay.
