I was charged with a section 5 and 6 last night, I am currently on probation from a preveous offence, is there a chance I could go to prison?

s5 of the public order act carries a fine - s6 involves the mental element

but it depends on what you were on probation for
because they can revoke your probation on a further offence can't they ?

there are others who will know that

IN the long term you are going to have to do what the rest of us do
when you go out drinking - you keep your hands to yourself......

I was previously convinced with assault and received a fine and was on tag for 2 months, and I have had to attend probation for the last year and got a few months left.
Oh ! this hasnt exsactly set the usual suspects alight !

for me I think it is unlikely
As Peter has said, Section 5 carries a fine only. There is no offence described under Section 6. It provides additional information to support Sections one to five.

out of the five or six answers

Incredibly there is a thread on a civil case - estoppel which is competely trumped up which is heading for 500 replies.
but you can only manage to get 6

anyway we think the answer is no prison

and now (or today) is the day for you to say - I have to change my behaviour
