Hi,

I have a question regarding my brother. Who was attacked by a colleague. Yesterday we were on lunch break at work my brother was heating up the food in microwave a guy R... Came into canteen and told him to remove food beacuse otherwise he will be late eventhough he just came in my brother said wait jus one minute is left and he opened up microwave and took his food out my brother who was standing next to him stopped him by grabbing his food n in mean time this guy punched him we have cctv in premises where it can be seen and they both started fighting and he banged my brothers head on radiator and his head and face started bleeding there were three other guys who tried to stopped them and took the guy to other end right under the cctv and when my brother got up his face was covered with blood then that guy picked up a fork and my brother picked up table and tried to stop him with small table and threw towards him and right after other boys and boss came in and situation became under control. My brother phoned police straight away police came after 30 mins and took the statement from witnesses, we told them to check cctv aswell they said we have enough evidence to detain him and took that guy away and told us to go to hospital. While we were at hospital they came back to check the cctv and told boss and other both persons will be charged because when fight broke up my brother tried to hit that guy again but we were not there to answer or not even that guy would have been seen picking up fork or whatever he was doing.
Police will come today to take statement and to charge my brother even though table did not touch that guy or he did not get any injuries at all. Do you think he can be charged?? Or should we withdraw the complaint?? Because he does not want conviction on his career.

Withdrawing the complaint won't necessarily stop them charging your brother. It doesn't sound as though they have much of a case however so IMO the charge is unlikely to be proceeded with.

More qualified responders will probably contribute at a more sociable hour tomorrow.

Have you heard of full stops?
Write to the employer and ask for the CCtv under the data protection act.

will he be charged ? WHo can tell the future ? IS he a cabinet minister with a bicycle ?

There are real anger management problems here that the emplloyer I think has to address - and the obvious way is by firing one or the other.

I mean clearly it is not about food but something else

No we are still waiting for police to come back to us.
