accident that did not happen
have had an odd letter from plod ! saying i have had an accident in a carpark, they are quoting all sorts of offences, how can i have an Road traffic accident in a private car park? when i did not have an accident at all. what shall i do?

Whether or not you had an accident only those present or those viewing any CCTV evidence can say.
However, you can be guilty of most of the Road Traffic Act offences (including careless driving, no licence, no insurance, no seat belt etc.) in a car park that is privately owned.
The Road Traffic Acts say that offences are committed if on a road or other public place. Anywhere to which drivers have �unfettered access� (e.g. a supermarket car park, a railway station car park) are �other public places� for the purpose of the acts, regardless of who owns or maintains them.
You are also liable to make good any damage or injury you cause to third parties (either yourself or via your insurers) for any damage or injury you cause, whether on the road, another public place, or on private land.

If it's a genuine article, there will be contact phone numbers / addresses where you can try to get some clarification.
There would also be details of your car, i.e registration etc, as well as a Police reference number which would indicate it's a genuine letter.
I'd try getting in touch first before doing anything else, if only to find out it's the real thing.

I had something similar happen - a letter arrived claiming I had been involved in an accident in Spot A, which I knew for definite I hadn't. On challenging it, I discovered they were actually interested in Spot B, and the purpose of the first letter was to get me, in challenging Spot A, to say where I had been at the alleged time (which they hoped would be Spot B.)
Firstly were you in the car park at the time they say? If so, I would still write and say you have no recollection of having been involved in an acccident - please could they give you full details of exactly what was supposed to have transpired and any evidence to support it..
(In my case it turned out I had backed into an illegally parked car and was accused by a witness. To this day, I never heard or felt a thing and there were no marks on my car at all at the alleged point of impact. I still wonder if it was somebody who had bent his car, parked it in an exposed position where this could happen and then accused the first sucker on the scene. However, I could have touched him without being aware of it - I will never know! The police said that this is not unusual)

A Car park that cannot be shut off from the road is still subject to the Road Traffic Act. If it is gates and that gate is shut just one day of the year then it is not subject and is wholly private and the police have no authority. Does the Car Park have CCTV - if so find out who operates it - the local authority will tell you that information.
