Hi everyone, I am having huge problems with an employment agency .
I registered myself with a local employment agency on the 1st October this year as I am currently unemployed. I filled out all the necessary paerwork etc.The consultant told me she would probably have some forklift driving work for me in the near future so I thought id had a result. (The work never materialised). The consultant took copies of id etc and also my P45 in full.
Before I left I asked for the P45 back but she said that that they would hold onto it in case they offered me work, (which they made sound very likely), but should I need it I could collect it anytime from them.
On Monday I called them asking for the P45 back as they still hadnt offered me work even after many phonecalls on my part. They said they couldnt find it. Turned out that they had sent it to another branch miles and miles away, apparently standard practice for them as far as clerical stuff goes. They told me over the phone that they would send it back in full. .
That was until this morning when I opened my mail to find only Part 1A in the envelope from them. Parts 2 and 3 were not there.
I assure you I had left all copies with them as the consultant had requested. I phoned straight away asking why they had only sent part 1A back and I was told they were keeping the rest until I told her that they had never actually been my employer as I had not done any work for them. She then changed her mind and tried telling me that I only gave them part 1A. I then put her in her place and asured her that they had all copies of the P45. She said she would call me back but I am still waiting for the dreaded call.
In hindsight, I know I should have kept the P45. Can they do this. What do I do? They were never my employers. Please help? Thanks.

Its not really an issue, fill in a P46 when you start your new job. It shouldnt take long to get you on the right tax code. If you later get your p45 back just give it to your new employer.
