Being turned down for an overdraft i applied online for credit report/score and spoke to their advisor.When my bank did the search they included my husband who has ccjsetc and i was rejected.Credit ref agency said banks can search my file only if i ask them to.Spoke to bank,explained all this and they insist they only searched me.i do not understand if my score/report is good with no adverse info.Does anyone understand the opt-in/opt-out on searches? thanks

When they do a search on you, the credit reference agency will automatically provide data on anyone who is associated with you (your husband).

The only way for them to not get your husband's details is to put a 'notice of disassociation' on your file - however, to do this you cannot have any financial link with your husband (even things like a gas bill in both names will be classed as an association).

Credit ref agency say this is not so .If u r applying solely in one name then u can instruct lender to opt out ie search only file of potential borrower

From this link, it seems that you needed to have requested to Opt Out when you first applied - I'm guessing that when you applied you either signed or agreed to normal terms & conditions which would have been the equivalent of an opt in.

Therefore, the bank has only searched you, but by default would have got details on your husband.

Also, it is worth noting that even if you have opted out, I reckon that the bank would still have rejected your overdraft as CCJs would still show up as they are public record and not private records (same as Voters Role info)
