Hi
I have a court order set up with my ex but he has just told me that he has stopped my monthly payments (and the kids pocket money) cos the company he works for, has gone into Receivership. Can anyone tell me what I should do if he breaks the Court Order I have for maintenance?
Thanks

The Court Order will, of course, be enforceable through the courts, but if you former husband has lost his job then he will be entitled to apply to eht court to have the order varied because he can no longer afford to pay. Unless he has other income, or finds another job very quickly, the court is likely to reduce the amount he has to pay to a nominal sum.
Didwot tells it like it is! However you should keep an eye on your ex and if he finds another job you may have to apply to the courts to have the order re-instated.

Thanks.
Does he have to apply to the court or should I?
Also if he doesnt have another job and doesnt do anything with the Court Order where does that leave me?
If he does apply to the Court, will he have to prove his earnings?
