i have had a visa for america has i have a criminal conviction this is now spent do i still need a visa to go again

Yes I think you do. It doesn't matter that it is spent and if you have had a visa before then they will probably have a record of this. So you would need the visa again.
The Rehabilitation of Offenders Act does not apply to U.S. visa law and so, by that criterion, no conviction can be considered spent. Thus you are ineligible to enter the US using the Visa Waiver Program.
