That Wiki article is quite interesting with regard to potential violation of terms of contract for data and usage by the US network Sprint. I would imagine that the new American Net Neutrality bill means they cannot impose a contractual restriction on using your mobile device to tether, since that would surely be considered as them "restricting the user's access to a certain type of data" i.e. data designed to be viewed on a non laptop or a PC.

The answer to dustypuss' question is therefore "yes" depending on the mobile make, model, software version and mobile network they use. None of which we know.
