I've sold a couple of ornaments on ebay and sent them 1st class signed for (£6.25), they arrives and the buyer says they are damaged. The buyer joined ebay 1 hour before they placed the winning bid. they say it is their first ebay ourchase, i took 12 pictures of the items pre-packing/posting. I have replied to the buyer attaching 5 photos, as that is the limit, they replied doubting that i had taken 12 pictures, therefore i have replied attaching a further 5 and asking if they would like the other 2 aswell. i have explained the ebay rules that they can return the item (at their expense) va a signed for/tracked service and if i agree with them i will refund the purchase price plus the postage, they are being quite rude and it suggests to me they are a seasoned EBAYER that for some reason had to set up a new account. what do you think?

do you think it is possible they have the exact same ornaments but they are damaged and they are trying to shaft me?
It's a possibility dot, hadn't thought of it from that angle but yes a very good possibility.
Dotty. I used to use ebay a lot. Every thing changed a couple of years ago. There are too many people out there who are less than honest. I no longer use it. I realise this doesn't help you but I'd tell them to go forth and multiply.
I was going to suggest asking them to send pictures of the damaged items, but I guess if your latest suggestion is correct it wouldn't help.
I'd go with your gut instinct Dot.

Can a seller open a dispute with Ebay or is it only the buyer?
I might tell the buyer that the items have been marked with 'smart water' so that you will be able to positively identify that they are the ones you sent.

But it may also be that the buyer has just decided they don't like them "in the flesh" and has deliberately damaged them ...
I know things get damaged in the post. When a buyer claims that to me, I ask for photos of the broken goods and the packaging - especially for such a trivial amount.
If I can see the goods are clearly damaged I refund the buyer and claim the value from the post office - the contract is with me as I posted the goods, it is my responsibility to claim the refund.

As a seller it is my responsibility to ensure the goods arrive in good condition. If they are lost or damaged in the post, the buyer should never lose out a penny.
They're dodgy ....... was the £6.25 the postage cost? How much was the sale? Perhaps they have a buyer for them already and are wheeler dealers ..... love the smart water idea - and yes, a seller can open a dispute with ebay - but if they send you photos of damage, I guess you will have to pay up .... sadly!!!

they are not saying they were damaged in the post, they are cl,aiming there has been a breakage and repair prior to purchase. there wasn't

I nearly refused their bid originally as i thought i had set my selling options to noone with 0 feedback but they slipped through!
