Hi there. new on here. just looking for some advice.

Basically my brother and his work colleague were attacked by 3 men last friday very badly. what had happened they had left work in the evening, female colleague was driving with him and his mate in the car.

She flashed at another car which didnt have there headlights on, and nearly crashed into them, it was around 9.30 ish. what the other car did was then follow them until they parked up, blocked them in and smashed the car with crook locks, and attacked my bro and his mate. fracturing his cheek and breaking his nose quite severe.

Police came very quick and arrested them. and said that the 3 men were known to police and this is one of the worst kind of assaults. they will be prosecuted.

What kind of sentence are they looking at.?

As i mentioned I'm new on here so please no pee takers.

it will depend on what they have been charged with and if they get found guilty
If they don't get prosecuted, then there's something wrong with the system (yes, we all know there is something wrong with the system).

It was an unprovoked attack - call it road-rage - or some guys out cruising and looking to cause trouble.

Whatever it was, they should be sent down for a couple of years each at least, depending on the severity of the attack, and what previous convictions they have. They could get even more severe sentences.

apparently they're gang members and had more than one crook lock. scum.
the way you describe it, all your brothers friend did was try to be a decent person and try to let these guys that they had no lights on.

I feel sorry for them that they ended up in the wrong place at the wrong time - totally innocent and it must have been terrifying for them.

I hope it gets sorted and that your brother and his friends dont suffer too many ill-effects from it.
The sentence will, to some extent, be determined by the exact charge brought by the Crown Prosecution Service. Looking through the list of possibilities on their website

suggests that the fractured cheekbone might lead to a 'grievous bodily harm charge'. (See Section 5 of that page). If so, the CPS have to decide whether 'with intent' should be added onto the basic GBH charge. (See Section 6 for the criteria which they'll use).

My own guess, based upon reading that document and studying court cases, is that a sentence of around 4 years imprisonment is likely

Yes..totally wrong place , wrong time, if it wasnt them who were viciously attacked it would have been someone else. bro has never said or done anything to anyone..

so scarry, to know that this could happen.. total crazy world..

Remember though, the court process can be a long and drawn-out affair, but not as long as it used to be.

Don't expect things to move quickly, and it can be something of a roller-coaster to go through.

Get your brother and the others to talk to a local Victim Support group, who will be able to help them out with what's likely to happen and they give excellent support and advice to people who've been victims of senseless crimes like these.

yes, i think the police have given him details of his local victim support group, will get him to contact them when he's better.

at the moment i dont think he's up to it. he's face is real bad and needs surgery on nose and cheek...

These thugs need to have the key thrown away. was totally unprovoked, i mean wat do these beasts get out of doing this, i guess they dont need an excuse..

There are a number of offences possible but the broken cheekbone is within the Grevious bodily harm parameters. It depends on the GBH offence charged (section 18 (with intent) or section 20 (without).

This would be the difference between a short custodial sentence and a long one. They deserve everything they get.

I even hope these underclasses got the no headlights offence bunged on the charge sheet!

I cant add anything to the excellent advice you have been given other than to wish them both a speedy recovery from this appalling senseless act.The lady ,although not phyisically injured must be severley traumatised.

You may find that there will be a ripple effect and people close to the victims wiil be in shock as well so look out for the signs -best wishes to all concerned x

i've heard stories about this - in america gangs drive round with no lights on knowing someone will be a good citizen and flash them to let them know, and when they do they go after them, but i'm afraid with much worse consequences. i seem to remember an email chain letter going round warning everyone, as it became quite common.

its sick, why would someone do that??

She didnt know that the car would be full of low life scum. and the didnt know they were being followed, locking the doors would have really made a difference? they smashed the windows while they were in the car.

Hey there I am due in court this week to give evidence against my ex for abh battery and perverting the course of justice! He is well known to the police for a string of violent offences and I finally fled to a refuge and reported all this last october. Be prepared for it to take ages to get to court and to be messed about a bit. I was due to give my evidence on monday and this is the 3rd hearing and it has been posponed again!!
I hope this idiots get what they deserve but what I am trying to say is be prepared for a wait before you get justice I hope your brother is recovering well take care x x
