i am getting marring soon and my new parter is in the navy we have been giving a house in cornwall for when we get married i live in milton keynes at the min can my ex stop me from taking my 14 year old we was never married and he is not on her birth certificate and have never paid me a penny for her he dose see her tho i dont want to stop him from seeing her and will do all i came to keep contact up with them i dont mind him having her school hols and will bring her to milton keynes as much as i can the live we are about to start will be so much better for her as we will be better off and will be getting away from the bad area that we live in now the school she will be going to is 100 times better

he is saying he will stop us and she could if she wanted to but she dont she wants to come with me to cornwall
not sure of the legal angle, but if he has never paid a penny towards her upkeep, isn't registered on the birth certificate and you weren't married, why does he have a claim on her - or at least her wishes..
Absolutely no way he can stop you. He sounds totally irresponsible - name not on your daughter's birth certificate, has never paid a penny towards her upkeep and most importantly, your daughter wants to go to Cornwall with you. Keeping contact with him is OK, but he cannot, repeat cannot, dictate what you can and can't do. He's given up any right to this.
when all else fails get solid legal advice, you could start with the Citizens advice bureau and go from there.
If he does not pay maintenance, is not married to you, does not have court registered assess and is not on the birth certificate he has no control over where she lives, it is up to you as her mother.
From a legal viewpoint you do not even have to tell him you are moving.

he will not give me money for her as i work and he get her things she need but he will not let her bring them home with her as i have a lil girl of 12 and she may use them he has always been the same to the point of making her take off the jeans and give them to him when he drops her off

he has never been to court and there is nothing saying he has to see her on x day or anything like that i just always done my best to be fair with him i did ask he for money when she was a baby and he said no he get her things when she is with him and i get them for when she is with me i did not fight him about it as i did not want to upset her but he is saying things to her about me moving like he will get the police and it is making her scared
I know a woman who wanted to split up and take the children 100 miles away. The courts agreed they had no power to stop her, even though she had been married and was in the middle of a divorce. Unless the parent with custody is being completely unreasonable or irresponsible in wanting to go ( say ) to a very distant country, the courts will not interfere. They might be very interested in the fact he does not help maintain the child, though. He is unlikely to go to court, because if he did the courts would almost certainly order him to pay maintenance - even a token amount if he is out of work.

As you have been told he CAN NOT stop you moving , he sounds a very disagreeable man you are better off without him.
If you want contact to continue I very strongly suggest that you get it arranged officially through the family court. There are quite a few things to sort out like where and when he can pick her up , how long he can have her, who pays the travel costs. I have never heard of a father making his child remove the clothes he buys her before he sends her home, that is just indefensible, a court would take a very dim view of that . If he gives her clothes then he gives them not lets her 'borrow' them.

This has reinforced my view , you are both better off without him !
Just move and make sure he does not know where you are there is NOTHING he can do . If he was stupid enough to go to the police/ court he would end up being forced to pay backdated maintenance for the last 14 years.
No no no no.....pack up your kit bag and GO.....he has no rights whatsoever in these circs.....get a new life and be happy.....good luck xxxx

I just a lil worried as he is saying that because she is 14 and is due to start her gcse`s in sep that the courts will make us stay here the navy have got her a school to start so she will not miss a day of school but he says if don't matter the court will make us stay
no court will do that, he has no claim, he is scaremongering, get help from a legal person, CAB than others if need be, do not be badgered, harassed into agreeing to anything, his demands are absurd.
