This is a UK site. In this country you can have an entire car load of passengers who're all openly consuming copious amounts of alcohol without anyone committing any offence.

However, the fact that you've posted at 2.24a.m. (UK time) suggests that you might be in the USA. Federal law requires states to enact legislation banning car passengers (and drivers) from possessing open containers of alcohol but it's left up to individual states to frame their own laws. It's therefore quite likely that the specific rules will vary from state to state.
