Argument a) Definitely not. There was no lasting physical damage, and people getting more lenient sentences when they are convicted of more serious crimes such as burglary!
Argument b) Definitely. This was a degrading act which would have lasting psychological damage on the victim.

Not possible, youngmaf. He was charged with Common Assault (and there really could be no other charge) which carries a maximum of six months.
To be fair, 3Ts, I did say "very few" and not none. There are always going to be cases like the one you mention. You also need to bear in mind that when sentencing to a custodial sentence a judge (or magistrate) firstly arrives at a sentence and then (separately) considers whether the sentence can be suspended. Of course it makes no material difference to the defendant - he walks if the sentence is suspended. One thing that does surprise me is that it is Judge Jamie Tabor who is involved. From what I read of his sentencing he is one of the more robust members of the judiciary. He obviously saw something in the scumbag which is not readily visible to everybody else!
