I already have points my provisional license.
I had an emergency well maybe not as such, but i had to pick my brother up from the airport whom i hadn't seen in about 6 years.(IT WAS A SURPRISE SO I WASNT DRIVING ON PREMEDITATION) Anyway to cut the story short i ended up crashing the car which belonged to my sister, just around the corner of her house.
I turned myself into the police station, almost 6 months later i recieve a court summons. i can plead guilty via written statement of mitigation.

can anyone help with what i can write in my defence i have already admitted to driving without a full license, but the charges are driving without due care and without insurance.

EVEN by pleading guilty and giving myself up to the police what chances do i stand of NOT getting a ban?
bearing in mind i alreaddy have 6 points on my license, and am taking driving lessons and hopefully book my test before the court date.????
Thanks alot whoever can shed any sort of light on my situation.

just for driving without insurance you can get 6 points, i'm pretty sure you'll be facing a ban seeing as this wasn't your first offence
I think that your stuffed, looks like a ban i'm afraid. but least you told the truth!
I personally think that its a waste of money carrying on with lessons and you might aswel walk till your points have all been taken off your licence (bout 3 years i think) cos your insurance is gonna be sky high, and thats if anyone wants to insure you!

In the mitigation part where i can plead guilty.
Does anyone know how to start off the letter?
i know i should be apologetic but i don't know how to start.
AND
would it look better turning up on the court date or just sending in the written plea of guilty?
They did take ALMOST 6 months to get that letter to me is that an indication that maybe its not as serious as i thought? OR i am being naive and optimistic?

Certain ban probably for at least 6 months but that's immeterial.

your sis may also get in sh1t for letting you drive with no insurance.

If you actually manage to get a full licence you won't find an insurer to touch you with a barge pole. I reckon it's 5 years mimimin before you'll be alllowed to drive legally.

THE thing is to protect my sister (being the nice guy i am yet very stupid) i told the police that she didn't know i had the car.

EVEN though she was the one that coaxed me to go get my brother.
basically i said i stole it, so that she wouldn't get in trouble and hopefully get her insurance thing sorted.

i'm not sure how long the ban would be for, it depends on the magistrate and what they 'do' you for exactly. for example someone i know got pulled for driving without his lights on, then had to admit his was on a provisonal and had no insurance, he got done for driving without due care, and insurance. 9 points on his license and banned for 2 years. I'm pretty sure the fine ws �500 but i'm not 100% on that part.

Also another point i'm a fleet manager and i check people's licenses for this kind of thing, if i see someone has been done for driving without insurance/ drink drving etc it can lead to the individual not being offered the job and that point, no matter how suitable they may seem otherwise
I mean add on the offence of no L plates! unless you actually had them. I don't think there's points but still an offence.

also now add Twoc-ing, possibly theft! You're now getting into the custodial realm. Lucky for you the jails are full so off the top of my head you'll probably get a ban, probably a year +�500 something of that order.

The judge'll be along no doubt he'll be more accurate.

OUCH! i dont think i will go to jail? wasnt drink driving. and they don't want me to appear in court if i dont have to. isn't that why i can plea guilty in writing?

But seriously do any of you guys know how to start off that letter? do i start it off with IM SORRY? or something a little less obvious?

I'm not gettin charged with theft. that part of the ordeal is sorted i'm just saying thats what i said in the police station. I think sis sorted that out sayin i DIDNT ACTUALLY STEAL IT but was saying it to help her out.

i'm not sure what you can say other than the facts about what happened that and that you realise it was wrong and you're sorry. Its not like your have mitigating circumstances e.g your sister fell ill and you needed to get her to a hosp asap, also there are those 6 point you have already........

my car was stollen and the driver crashed it...only minor! he had a provisional licence and got done for theft of a motor vehicle and careless deriving and leaving the scene of an accident and got 9 points and a 15 month prison sentence.
Would have cost you less and saved you less hassle if you had pad for a cab to collect your brother, or used public transport.

Driving on the motor with no licence, insurance etc etc is unforgivable, and lets be honest it wasnt exactly a life or death situation, but you could have innocently killed anyone on the road.

As far as a letter of mitigation goes, there is very little mitigaton but just explain what you have here, be polite and contrite. It is also worth going to explain yourself, write notes down and make the points to the beak when you get the chance. They take it as a sign of respect if you show up and explain and don't look like a sack of sh1t! Hide all your piercings and tough stickers if you have them. good luck.

I' m sure Nate is feeling gutted right now and this kind of message doesn't really help matters. Have you ever done anything wrong, spaced?
ps , plenty of people with a full license and insurance kill people on the road. The insurance tends not to bring the victim back from the dead and the 'uninsured' are 'insured' in the UK anyway, by way of a collective fund from the insurers.
No it doesnt really help Meredith but surely Nate would maybe learn from the first time that he got 6 points!!!
People like this shouldnt be allowed on the roads they have no regard for the law !
I dont think that the insurance would be an issue if he killed someone.... HE DID NOT HAVE A VALID LICENCE!!!
THEREFORE should not have been driving on the road!
If you are provisional it kind of suggests that you are not qualified to drive... i.e your standard has not been assessed!
Meredith - compensation through the scheme for uninsured drivers is capped at a relatively low rate.

Compensation from insured drivers isn't. So there is a huge difference.

There is no mitigation - this was premeditated - you decided to get in that car and drive.

You will be banned and could go to prison.
