i was turning out of a T-Junction on to a main road. Someone had let me go from either side and as i edged forward to check the far side of my left, a car hit me on the front side and knocked my wheel arch. there is only one lane, so effectively he was overtaking the stationary car. he said it was my fault as i'd driven in to him, but i'm sure from the damage on my car it is clear that he drove into me.
for insurance claims, who is in the right or wrong?

Without knowing all the exact details, I can't say for certain. But vehicles are not supposed to overtake at a junction (which is what the other car was doing). If there's any justice and common sense in the world then he will be found liable.

See section 167 at:
www.direct.gov.uk/en/TravelAndTransport/Highwaycode/DG_070314
need to find out why he thought it was wie and safe to overtake a stationery vehiclgiving way. Without the full details it seems that he is liable.

Just make sure that you report asap and tell the insurers that you checked, indicated etc etc
I agree with the above, but did you get any witnesses to confirm what you said happened? If so you should be ok but don`t always trust other drivers who give you hand signals to say it`s all clear. Sometimes they may imply that it`s unsafe
