i was recently stopped for speeding, i was given a fixed penalty ticket. I did have the cruise control set to 80mph on a duel carrigeway. the ticket states that i was doing 120 mph plus, i asked the officer how he came to this conclusion only to be told he had recorded evidence which he refused to show me.
he told me that he had to go in excess of 145 mph to catch me,is that legal without blue lights?
the officer then started to read me my rights on driving whilst using a mobile phone,he got halfway through before he realised it was the wrong caution.
he then put two different dates on the fixed penalty ticket (is this leagal on this type of document) then to cap it all when producing my docs i was outside of the seven days (this was due to me going to work at 5am not getting home till 8.30 pm and our local police station shutting at 8pm) so they would not accept payment of the ticket, when i said to the lady at the police station that i didnt think dates mattered as the ticket had two different dates on it, she replied "that is just a mistake" she then asked me what date it was that i was stopped i told her that i couldnt remember, she told me not to be so silly as i was the one that was stopped i must know the date, i politely replied that the police officer was also there and it was quite obvious that he didnt know the date either, How do i stand on this scenario????

You would have been reported for 120mph not given a fixed penalty ticket. You would also have been considered to be prosecuted for careless driving.

He would have timed you over a fixed distance or recorded you using vascar. They have this instantly available in their cars for you to view in such circumstances- I find it hard to believe he would say he can't show you.

Yes - he's a traffic officer and trained to do so and it was obviously necessary to catch you.

Rights are the same whatever offence you have been accused of all they basically say are that you dont have to say anything etc whatever you say will be written down and given in evidence - he would then have asked if you understood these rights.

Were they weeks apart or did he just correct the date he intially wrote - say he may have just written the wrong date down.

You nominate the police station that would suit you taking the documents. Best to keep them with you if this is the case with the local station.

You send off the payment with the ticket you dont pay it when you show your docs - it would need to go to a different police station.

Yes you were it was 7 or so days ago you must have remembered.

johnvictor - the reason why I asked you what speed you were travelling at immediately before you were stopped was for a simple reason. You have admitted you were travelling at 80mph so whichever whay you look at it - YOU WERE SPEEDING, THEREFORE BREAKING THE LAW!

the awnsers are exactly what i would have expected, strange but true, everything i said was the truth, i did try to pay the ticket as i know i was speeding at 80mph, and was willing to accept this, but as i said the officer put on the ticket in excess of 120mph to which i do not accept.
this is the first time i have ever been stopped for speeding in over 25 years, so no i do not expect to have to carry my documents around with me , just in case i get stopped , and just in case the police station may be closed.
do all police stations now shut at 8pm?
no wonder crime is rife.

by the way, norman the dog, can you tell ME where to find my other postings you say i have made, i would love to read them

First of all Have your cruise control system tested depending on the outcome i.e. it is ok then challenge the offence in court through a solicitor. Secondly, Ask the Police force when the last time (ask for written proof) the speeding system on the police car was calibrated. Again if this is not forthcoming challenge the case. If the officer had recorded evidence this would normally be of a video type recording and any reputable officer would actually show you the playback, it appears to me as this officer is either lying or bluffing you into an admission. Unfortunately the two dates are irrelevant since if the offence is proved and you admit to being there on one of those dates case proved. It is not now a defence to say that the officer has got the wrong date and in any case he would have recorded the correct date when completing other paperwork . Highly unusual for a police car to travel at that speed to catch you without the blues on, but yes he can travel at that speed without blues, silly I know. So, was you using a mobile phone if so which offence did he issue the FPN for since you have allegedly committed two different offences here. Speeding and Using a mobile phone. How do you know it was the wrong caution. It should have been "I am reporting you for ?????? You do not have to say anything, but it may harm your defence if you do not mention when questioned something that you later rely on in court, anything you do say me be used in evidence" but remember the Judges Rules state that the caution does not have to be word perfect these days if the offender fully understands why they are being reported. The enquiery office at the Police Station would not have accepted payment of the ticket anyway, it is the court office. The officer would know the date of the offence because a) he would have a carbon copy of the ticket and
