Is it legal to display my Road Fund Licence at the top of the windscreen in front of the rear view mirror

You are advised to place the tax disc in the lower part of the nearside of the windscreen. So it can be read from the pavement by whoever has cause to read it.
It is NOT ILLEGAL to display the disc on other parts of the windscreen, as long as all details are fully visible.
The Road Vehicles (Registration and Licensing) Regulations 2002, Reg. 6 gives details of where the licence should be displayed. On a vehicle with a windscreen extending across the vehicle, it must be displayed on or adjacent to the nearside of the windscreen.
I recommend that you display it where the Old Bill expect to see it. I went through a phase of being stopped regularly and each time I'd get a surly copper having a hack at me for some vague reason. Eventually I realised that they were pulling me because they didn't spot my tax disk as I drove past, and then when I stopped rather than admit that they hadn't noticed it, they'd make up some other excuse for stopping me. As soon as I moved it to the bottom of the windscreen, they stopped bothering me.

When and where to display the disc
A vehicle tax disc shows the registration number and the date up to which you have paid vehicle tax. It comes into force on the day it is issued. But, if you apply for a tax disc in advance, it comes into force on the first day of the following month and you should not display it on your vehicle until then. You must display this disc on the left-hand side of the vehicle's windscreen. If the vehicle does not have a windscreen fitted, you will need to display the disc on the passenger side. For motorcycles, the tax disc should be displayed on the near-side of the bike. If a side car is fitted to the motorcycle, then the tax disc must be displayed on the near-side of the handlebars or on the near-side of the side car.
