I was about to pull out of a car park to turn right but had to cross two lanes of oncoming traffic going left. The lights were on red for these two lanes and the driver in the first lane waved me out as it was clear. I pulled out but stopped before proceeding to cross the other lane as i could not see if it was clear. It was clear so i stopped to wait for the traffic in the right hand lane to be clear to continue turning right. A couple of minutes later a car shot out of the first lane where the car had had signalled me forward and into the lane i was stationary in waiting to move forward and crashed into me even though the lights were on red he did not see me or slow down. Who is in the wrong here?? I also have a witness who was walking on the path that said they saw what happened and said it was the other drivers fault who crashed into me.

if you were stationary then i cant see if it was your fault at all.
But let your insurers deal with sorting that out, just make sure you have witnesses details.
