smoking ban

Now the ban has been in for a while, nearly all the cafes and pubs are putting tables and chairs out on to the pavements can they do this? or do they need permission, or a licence? now with every body smoking outside it's like walking through a fog.

Cafes need a licence from their local council (under the Highways Act 1980) to have tables and chairs outside on the pavement. If you think a cafe has put tables and chairs out without a licence contact your local Trading Standards.
On the smoking front, I also seem to encounter more second-hand smoke than before the smoking ban - a cold, wet winter will sort out that out though!
