my sister is splitting with hubby - they have owned their home (on joint mortgage) for 3 years. Previously they lived in his home for eight years and my sister bought the food and paid some bills whilst he paid his own mortgage. As such, when they bought jointly, he sold his house and put �80,000 into the new home and they have a �60,000 joint morgage. As they have been together for 13 years and married for seven, (no children) will my sister get something out of the sale of their joint home, or will he be able to claim back all of the �80,000 he put in in the first place. I would have thought that they would be entitled to an equal share as the house is jointly owned.

In most cases it doesn't matter who paid the deposit ~ if it is a joint mortgage both are liable for payments..and both are entitled to a settlement. The amount could be argued about in court, which would be costly. Hopefully they can both reach an amicable agreement without losing a lot of money in legal fees.
