Went to garage Saturday -expressed interest in a new model foolishly put down deposit £700 did not sign any hire purchase forms Realised Monday I did not want to continue rang garage today -they have car although I told them did not want it until end of January tpold them I wished to cancelhow do l stand legally

i think it will depend entirely on what you did sign
Presumably, you must have signed SOMETHING (order form?) to order the car and have received a copy of it? Look at the small print...it may say that you will lose your deposit.
As bednobs - & I have a feeling you may be able to change your mind within a certain no of days though regarding the purchase (cooling off period)but I'm not sure if it applies to deposits to take it off sale- check what you signed - the deposit would have come off the purchase price anyway.

You told them really quickly so they may refund part (admin or something) and put it back on sale.

So many garages and they all do different things. How did you pay?
Did you come away from the garage with any carbon-copy of what you signed?

Are there any terms and conditions on it?

You should, at the very minimum have some paperwork - a receipt - to prove that you've paid this deposit.

Every car for the last 30 years bought from same garage so the only thing I signed wascredit card slip f0r deposit-the higher purchase was not signed.see them tomorrow about it-rang them to say I had decided to cancel you can imagine they were not happy-what gets me ordered it Saturday it was in their garage Monday even though they knew I did not want it till end of January.I am sure I will be bombarded by them so I wanted to know what the legal postion was.will let you know outcome

well it has been an expensive mistake!!!! went to garage this afternoon and cancelled ---lost the whole deposit.
That is what deposits are. You made an agreement to by the car and paid to back that commitment. You later revoked that commitment and they get to keep the deposit for their trouble.
Oh dear - an expensive mistake.... a lesson for all of us.

Unfortunately, that's what deposits are for. They may have turned down other buyers thinking they had agreed a sale with you. I doubt there is any right to a refund but a lawyer may know.

thanks everyone for comments.the garage say they have 15000pound car on their hands which may be dfifficult to sell----as it is Vauxhall corsa I think they may be ok I am so pleased to be free of sale accept I have made a stupid mistake and will not pursue deposit I have learnt a costly lesson

Gosh, I wish I was that rich that I could walk away from £700.
They shouldn't have ordered it in so quickly, then - I'd chase it up to make sure of your rights. You are such a long-standing customer, but people don't take things like that into account these days. I too couldn't afford to lose £700 without a fight!

not so !!!!but I am not confident enough to pursue the matter++++ had a sleepless night about it but will have to live with it
you say they got the car to their showroom within days of your order - that is not easy - it must have taken them a fair bit of effort and cost to have it brought to them etc, and as they say they are now stuck with a vehicle they don't want

if you could just cancel and take back deposits whenever it suited, on a whim, there would not be much point in having them.
..but he said he didn't want it until the end of the month, joko - why get it in so soo?
