accident in work time

injured at work driving company van injured lower back etc car hit me from behind when i was stationary hard impact untraced driver can i make a claim on company insurance policy or employers employee company insurance.had this 40 months a go this accident and still got problems

I'm sure you'll get an answer today, but if you had it here in Ireland you would a)be able to claim on the insurance, but b) be time barred after 2 years has elapsed.

a claim for what? Did you have to have time off work, and thats what you want to claim for? I cant see how your company would be liable at all, as they coulnd't have made reasonable provision that an idiot wouldn't have crashed into you!
or you want to claim for dammage to the vehicle?
personal injury claims have to be submitted within 3 years of date of accident.
You would need to check the employers insurance policy as to whether you can make a claim in them
