Solicitors make a good living from boundary disputes. The best form of action is to read the literature you can find on the internet and try to solve the problem peacefully between yourselves. This site may get you heading in the right direction:

Well are you on his boundary?

If you are why did he not say anything at the time?

He could claim compensation but this will be reduced as he made no coment at the time.

But please try and sort this out as it not your are heading for costly problems.

Also you will have to tell any buyer that you are in dispute if you wish to sell.
