if i erect and pay for new fencing do i have to let my neighbour have the best side

You'd normally have the posts on your side.

No you don't have to at all. As long as you get on well with your neighbour it won't matter.


The only snag is, if there should be a dispute in future years, with a post and rail fence it is the side which has the posts which is regarded as the legal owner.


Have you considered a concrete post and panel fence with slot in panels? That way both sides are the same.
