Are there any laws about ice cream vans, how long they can be in an area for? There's one around us, I first heard it today about 3.30 and its still driving around now playing the same awful tune and its nearly 8pm!

If it really is a problem then you need to speak to the Environmental Health department and ask them about the noise regulations concerning chimes as I would imagine it would come under a noise complaint.

Most councils have a limitation on these chimes and allow them only between 12 mid-day and 7pm. Check with your District Council. There are other rules like 'no chimes on return to the same length of street within 2 hours', 'Maximum chime duration 4 seconds at not less than 3 minute intervals', 'No chimes if there's another van in sight in the same street', etc, etc. (Control of Pollution Act 1974) The vendor may not be aware that there could be a fine of up to �20,000 involved! Ouch!

It may well be that such an activity is contrary to local by-laws etc as stated above but also consider Section 62 Control of Pollution Act 1974:


This section, subject to a few exceptions, makes it an offence to operate a loudspeaker in a street

(a) between 9pm and 8am for any purpose

and

(b) at any other time for advertising any entertainment, trade or business.


Exceptions include:

i) loudspeakers operated for police, fire brigade and ambulance purposes

ii) vehicle radios, tape and players etc where they are operated for the entertainment of the driver or passengers and are not operated so as to give reasonable cause for annoyance to others in the vicinity

iv) vehicle horns when operated for giving warning to other traffic and when operated so as not to give reasonable cause for annoyance to others in the vicinity

v) loudspeakers operated between 12 noon and 7pm when used to inform that a perishable commodity for human consumption is on sale from the vehicle and when operated so as not to give reasonable cause for annoyance to others in the vicinity
