i finally got my Personal Independence payment letter to
do with claiming it, as my Disability Living Allowance is
stopping, and the PIP people have turned me down flat
so i am not a happy bunny this morning.... i was happy for
Christmas but this has taken all the joy out of it

i am upset by the way, as i sat through an excruciating 1 hour and twenty minute interview assessment and
felt it had gone all right.

looks like i will have to tilly, my welfare rights adviser is on leave till monday, have left her a message
to get back to me. I am so angry i could spit....

even the welfare rights adviser said on the day i had my assessment, she was here with me, that i would
just get a transfer from DLA to PIP no problem
boy is she going to be surprised.
I can appeal but the letter from the PIP benefits people is fairly comprehensive 0 points on everything
I'm led to believe they turn down a lot of cases in the hope that the applicants don't appeal. Appeal and you'll probably be successful.
As advised on your other thread, ask for a copy of the assessment, see if you disagree with the contents and ask for an MR.

what's an MR, the letter i received gives a blow by blow account of my form, all 60 pages and my assessment.
as i have said turned down flat. I will appeal but this has to be done within one month...
MR is a Mandatory Reconsideration. You cannot appeal unless you have asked for an MR and the original decision has not been changed.

Sorrie emmie but you will have to fill in form. Capita are just making it as difficult as they can for people hoping they will give up with claim. You need to keep fighting for the money you are due, should be back dated.

emmie I would get onto PIP ASAP to get a claim registered.
You will probably fail in your MR. Emmie, but fear not. Chances are you will win your case in the tribunal which you will have to organise, yourself. The crossbar keeps on being raised by the Government. As has already been said, a large percentage of people are awarded 0 points, ask for an MR and are disappointed when that agrees with the initial assessment. However, the tribunal is chaired by a doctor and someone from the legal profession, neither of which have any obligation to the DWP. Quite a large percentage of tribunals are found in the claimants favour. And any benefits lost will be repaid in full, though it may take a good few months.

thank you, i have been this route before when i had to go through the mill to get ESA. 18 months that took and put me in hospital with a breakdown..

sorry the Welfare Rights adviser is mine, she has seen me through this and other matters. she won't be in till Monday so will have to wait till then to see what we can do. I will be left with £111.00 a week to live on if this doesn't get sorted. That means all bills will have to be cut to the bone... i am sorry sounding off like this.
