I am living with my husband in the house he bought over 3 years ago, im not on the mortgage but am on the secured loan which we have on the property. We also have joint bank account and my name is on the electoral roll and all the utility bills etc.



If we were to split up would i be entitled to half of the house?

By the sound of things only on the basis of matrimonial law, rather than property law.


If you are married the court has fairly extensive powers with regard to property.

If you were to split up and divorce then the marital assets and debts would all be put on the table and divided either by agreement or in the case of dispute by the Court. By the fact that you are married you have an interest in the property but it would all depend on how long you had been married, what other assets or debts you have etc.etc. If you are thinking of splitting up then see a solicitor for a free consultation or go to the CAB.
