House & A Baby - What Are My Rights? Advice Please

I have been with my partner for 5 years and we got our first home together in August 2023 and I gave birth to my daughter in November 2023.

My partner and I do not get on anymore and it's become toxic. He doesn't help with our daughter in any way apart from paying the mortgage while I'm on maternity. 
 

I want to leave.

I can't afford to leave and rent anywhere while on maternity but I don't know where I stand. 
 

Can I go to the council? Will I be able to get help if I have a house in my name?

 

He is being difficult and will not leave the house.

 

Ive stayed for longer than I've wanted to because I don't know what my rights are or what my options are.

 

for context. We're Irish living in England so our family is in Ireland.

There are many single parents and families living in hostels, bed and breakfasts and hotel rooms because there is a real shortage in social housing, so don't expect to be housed quickly.

Is the house in your name, too?

Can you move in with your family in Ireland?

If your name is on the mortgage you will still be responsible for paying it even if you move out.

Sorry, I don't really know how to use a sewer bank so unsure if I can reply to individual responses.

Yes, I could move in with family in Ireland but that would be a last resort. My baby is 5 months old and wouldn't want to be a burden on anyone.

Living with a young baby is hard. As much as I don't want to be with my partner anymore, I want him to be able to see her easily if he wants ants too.

I am aware the mortgage still needs paying even if I move out, my partner is currently paying it while I'm on maternity leave and I get everything for the baby.

If you moved out at the end of your maternity leave you would have to pay rent and childcare.

Your baby is very young and such a major change in your life often causes strain between partners.  Things might improve over time.

Is there any equity in the house?

 

If things got really bad you could seek an occupation order and force him to move out.  You are both still in the early days of parenthood however and perhaps you should both try to meet each other halfway and resolve your differences before making any rash decisions.

We have been struggling since before I found out I was pregnant. I was very naive to think a baby would bring us closer and solve everything. It's 10x worse.

Unsure about equity. We have a 5 year mortgage contract and havnt even been in the house a year so we would have to pay a fee if we broke that contract.

 

Can you claim half the house?
