My sons wife walked out and left him to bring up 3 children by himself over a year ago and want`s to know when he may proceed with divorce proceedings. She left to live with another woman, if you know what I mean??

I would say talk to a solicitor but i think he could go now on grounds of infidelity.
He can start proceedings now if he wants..........is he going for maintenance for the children too?
I didn't think there was any restrictions when one party has commited adultery.
Would a lesbian relationship constitute adultery?

Note the second paragraph, specifically "opposite sex" and "six months".
I would consider it to be.
Perhaps he should go for desertion....
Mark.....quite interesting......that means that, as far as divorce is concerned,homosexuals cannot commit adultery.

Male homosexuals can commit adultery in the eyes of divorce law, but female homosexuals can´t.

Divorce could result in the family home being sold and the children being disrupted. If she starts proceedings for her 'perceived' gain of 50% assets it would be up to a magistrate to decide the outcome. Advise your son to keep the kids & property at least till they're all independant.
