Hope they throw the book at those two soldiers or at least send them for a diversity course.

The hand wringing lefties and "right on" PC brigade must be loving this..... bunch of ***... send our soldiers out to do a job where there are no rules then criticise...

The Inquiry was set up after criticism of the Secretary of State for Defence, and the MoD by three high Court judges. After the allegations were made, instead of fully investigating them and refute them, they attempted to gag and be uncooperative in attempting to find the truth. That angered the Judges who were highly critical and the Inquiry was ordered soon afterwards.

// "We are forced to the conclusion that the approach of the secretary of state to disclosure in this case was lamentable," Lord Justice Scott Baker, Mr Justice Silber and Mr Justice Sweeney ruled today.
They said that when he was armed forces minister earlier this year Ainsworth signed a demand for a gagging order even though the information he sought to suppress had already been published. The matter caused the judges "very considerable concern", they said.
Over more than eight months, "the secretary of state's agents had simply failed for no good reason during that lengthy period to carry out these critically important and obviously highly relevant searches [for documents]", the judges added.
They singled out Colonel Dudley Giles, deputy provost marshal – deputy head of the military police – for "lamentable disclosure failures". Asked why he had not referred in his witness statement to a document stating that the soldiers had detained between 10 and 12 Iraqi detainees, Giles replied that he did so to avoid prejudicing any future prosecution.
"When this assertion was examined, it became obvious that it was wholly without foundation," said the judges. //

and the as a result the officials have been promoted and are in charge of Syrian propanganda, and the returning-terrorists program and we have to pay for a £30m inquiry. The lying officials pensions have NOT been affected you wil be relieved to hear

Phil Shiner and Leigh Day failed to disclose an Arabic language memo where the litigants accepted that there had been no deaths.... oops
Govt will therefore try to claw back the £2m costs of the JR ( see above ) which was all about ... non disclosure. Both teams have been referred to their regulator for malpractice. double oops.

Oh dear Leigh Day get a document saying all the dead people were insurgents and not innocent civiliam bystanders in 2007 and disclose it in 2013 - ooooooops !

Sadr (Quds) (“the OMS”) in Al Majar al’Kabir the local branch office of the OMS . It lists the
names and other details of the nine detainees. The OMS is an organisation known to have
close links with the Mahdi Army and one that was openly hostile to Coalition Forces in Iraq in
May 2004. It is clear from the document that the nine detainees were all known to the OMS.
The document lists seven of the former detainees as members of named “platoons”. The
other two former detainees are listed as “volunteers”. It is highly likely that the “platoons”
were military units in the Mahdi Army and the expression “volunteer” is a reference to that
particular detainee’s current status in the Mahdi Army.
47. It would appear that the OMS detainee list came into possession of Messrs Leigh Day, the
solicitors acting on behalf of a number of Iraqi citizens, including many of the Iraqi Core
Participants, in respect of civil claims that had been made against the MoD arising out of the
events of 14 and 15 May 2004. On the evidence it is likely that Leigh Day came into possession
of the OMS detainee list in Damascusin September 2007 when there was a meeting between
staff from Leigh Day and a number of Iraqi nationals including Khuder Karim Ashour Al
Sweady (witness 1), the uncle of Hamid Al Sweady (deceased 3). In my view the source of the
document was almost certainly Khuder Al Sweady. "
