A person falls off a treadmill at the gym that someone had previously left running suffered fractured right shoulder etc who is to blame the gym owner which is the local council, the lady for leaving it running or the gym manager in failing in his duty of care? any personnel injury lawyer's have an idea?

I got on an escalator at John Lewis earlier this week but received no training. Fortunately when I got to the top I realised it was moving and made sure I stepped off. However I do remember using an escalator somewhere (Debenhams?) last year and they had a recorded message telling people when to step off.
It would make sense for these treadmills at gyms to cut out when no-one is on them- in fact I thought that was the case. I have only ever seen stationary ones and when I get on the speed builds up slowly even if I set it at a high speed.
They tell you at Gatwick, too, factor, when you are coming to the end of the moving pavement.....
