i was at at a friends wedding when i fight broke out towards the end of the night. i went outside to see what was happening as someone said my friend was involved. when i got out there i couldn see my friend as he had already left. when i went to make my way back in i was confronted by someone who head butted me so i hit him back in self defence. i then ran off to safety as i felt dizzy from the head butt and i could see other people comin towards this particular scene. im lead to beleive other things happened to the person who head buteed me. i dont who or what happened when i left the scene. i then see my girlfriend and got a taxi straight home. the next day my friend told me his father in law got arrested and i was 99 percent certain he didnt do anything wrong otherwise i would have seen him. this made me feel as if i needed to give a statement in his defence. he then got let of the hook but
since then i have been charged with gbh section 20 as the person who nutted me claimed i kicked him in the head when he was on the floor. which i obviously didnt. apparrently there are 2 people saying i did it and i had to do an id parade. i havent heard from the police to say weather or not i have been picked out but as i have been charged i think i have. in their statements they are sayin there was me and four other people involved but there is only 3 of us goin to court. what can i expect? i hope i dont get accused of something i havent done and i am really worried

oh and eddie, i wasnt a 'leader' i was out there for the purpose to see if a friend was there as i heard someone say he was. if he was there when i went out then i would have tried to stop the situation. he wasnt there and i was then confronted by this guy who head butted me. i only hit him in self defence like i first mentioned. i dont know what happened after i left the scene which means anyone could have done the damage. that is even if he did get kicked. he may just be sayin it to soften then fact he knows he is the wrong by head butting me which was unprovoced. thanks
I am not saying you were a 'leader' or even that you are guilty.
I am looking at what the prosecution are going to say if / when this comes to court.
The facts are that 2 witnesses say you did do it and they have identified you on an ID parade. 5 people were involved but the evidence against 2 of them is not strong enough to charge them. So the evidence against you is stronger.
If you are going to plead not guilty you need some evidence to prove that, what evidence do you have? Just saying ''it was not me'' is not going to be enough.
Question Author
The other two are not in court because the police dont know who they are
Question Author
Could this go in my favour and will it be harder gor the court to find someone guilty?
no
>>>how can both people be 100 percent it was me that kicked?
Please see my previous post regarding 'joint enterprise'. The witnesses could specifically state that you did NOT kick the victim but, if it was proven that you were a member of a group of people committing the assault, you could still be convicted as if you actually did so.

>>>could a suspended sentance be possible
A judge can pass a suspended prison sentence if:
(a) a non-custodial sentence is not possible ;
(b) the custodial sentence does not exceed 2 years ; and
(c) there is no additional risk to the general public by so doing.

Ok thank you all for for the time and effort. And going by what has been said what do you think the likely outcome will be? Sorry for the questions but im sure you can understand what my mind is goin through. I strongly feel as if i acted in self defence and now i been charged with something quite serious. Im just worried
seriously, we are just going round in circles - anything that anyone guesses is hardly going to be helpful - if i "guessed" that from the info given, you'd be found not guilty, that's hardly going to help you when you are sitting in prison, conversely if i "guessed" that you were going to prison for 18 months, how would that help?
I can't stress enough that only you know the facts of the case pertaining to you, because you can hardly give a comprehensive representation in 4000 characters per post. The posters have pointed you to the relevant documents any judge will be refering to, so you'll just have to work it out yourself how likely things will be to happen, or even better, speak to your solicitor who will have the benefit of ALL the facts plus experience in this area. You need to speak to your solicitor about your defence of "self defence" too, because i'm not sure that hitting someone first is self defence.
As you have been told only your solicitor can advise you as to the possible outcome. We can can not know all the facts , we know nothing of the prosecutions case at all , it will certainly be different from your account.
You have still not us what , if any, evidence you have that you did not kick the victim . If the 2 witnesses are going to say you did then you need other evidence to say you didn't , do you have such evidence ?
