in nov '08 i was arrested on lies (which was proved) but i was assaulted by the officer that arrested me.

i put my complaint in and are still trying to get answers as they'vce dragged their feet so long they feel they don't need to answer anything.

tthe officer siad he was leaning over me talking to someone in the car but the 2 officers statements state they were both out the car, i went back with a second question of who was he talking to??

good enough question but they dont want to answer, IPCC tell me go back to PSD and PSD say go to IPCC.

due to believing i have a right to have any question answered to my satisfaction i have asked for a meeting with chief constable of west mids police and he's refused so far.

what are my rights surrounding this and how will i get listened to or will i have to climb the H.Q to get his attention

Difficult thing is proof in this situation and what a court would find reasonable.
I know somebody who grabbed by a plain clothes police officer at 2am. He fitted the description of the thief they were trying to arrest.
The officer shouted he was police but there were no uniform officers around at that point in time and he kicked the officer hard in the knee as he thought the police officer was a mugger. He was not the thief.
It could be said the officer should have shown him identification but probably he did not have time.
Fortunately the officer went to hospital but there was no lasting damage.
The police took the matter no further but it could be argued the police officer had been attacked or it may be argued it was the person's right to defend himself.

cheers, there were 2 witnesses that police got a statement from that state he was leaning over me with his hands on me and me cuffed.
PSD stated in a letter "the officer was talking to someone in the car"
since the start of 2009 I have been asking the same question "who was he talking to and why did he have his hands on me"
police have failed to give any answers to this has 2 officers came out and both were out the car, but to be fair to his partner he backed off as he knew the 1 officer was in the wrong.
The same day I was kept 21 hours without food & water and that was proved but unsure what else i can do apart from get them to admit it (which they have) and had all this done and was found 100% innocent on a made up story who pointed the finger at me to get theirself out the s@@t.
