Help with CSA

Hi, Well the ex put in a claim for the child benifit and the Ex has won the Child Benifit for one of the children and me the other though he does not do any of the doctors or other stuff. But apparently if fair as their are two children and we both have parental responasbility. (thats what CHild Benifit said!!)

Anyway he has now called me to say that he will call the CSA and claim of me as I work and so does he but hay ho (how predicatable I didnt see that coming not). I know to now stop anymoney that I would give to my child regarding up keep but have heard that the working tax credit can be included but they only look at it if you are the lower earner I am the high earner of my new relationship does any one know if this is at all correct.

Myself and my partner have 5 children between us but his ex has the child benifit for three can I include is 3 and the one that I have when the CSA ask me how many children we have as his two eldest move from house to house?

My EX is just spiteful and a twisted indevidual he earns over 40k a year but is a jealous man with a huge chip on his shoulder. I will pay what ever the CSA say though my child will not be given any of the money for their benifit. Child Benifit office sucks and before you ask I did agrue the case but they say we both have parental responsibilty and this is fair my child that my ex has is 14 in november.

Can anyone shed any light on my questions.

could you clarify the questions pls?
So, does one of your children live with your ex and one live with you?

If you pay CSA for the child that lives with him, he must pay for the one that lives with you

And yes, quite what is your quesiton

Sorry Guys a bit of a ramble. The children are of an age where they stay at theire dads over night if they want in the week and make their own way to school they are both in secodary school.

My Question is Do the CSA take into account the WTC and if a joint claim is the less waged claiment the one who the CSA would put the credit as their money. I have been told that they take WTC into account though this is money for the other children.
if they regularly stay with 'the other parent', then an equitable division of the benefits you (both) claim for them should take place.

Surely if CSA decide you pay for child that lives with him and he pays for child that lives with you then they would just cancel each other out?

Dont know about you, but my hubby pays CSA to his ex and my wages arent taken into consideration at all. And they didnt include WTC in their calculations either.

Eaxctal but he has made a claim and now I will pay the CSA for my son and I will need to make a counter claim for my daughter so the CSA will be taking money from me to give to him and from him to give to me. You would think a MAN on 40 K would GET A LIFE
perhaps he will do what many men seem to do - once they are contacted by the csa make themselves unemployed
they may not let him, if the sums are equal.

My hubby pays a fortune to his ex, has never missed a payment, and yet she wont let him see child(dont ask!!)

In contrast, MY ex has never paid a penny for my son, claims to be ill blah blah, yet works and earns a fortune cash in hand. Makes my blood boil!

we have just lost a court case and MUST let our grandson see his violent, layabout, jailbird father (or face imprisonment) ... and we don't get any money either!
cath the whole court system is so flawed it beggars belief. Mr Smow has been granted 5 court orders, (re done every year because ex keeps breaking them) ordering his regular contact with child etc etc, yet still hasnt had her since xmas! Ex just lets him keep paying to go back to court - yes SHE breaks them yet HE has to pay to take her back to court.
wish i lived near you! the court and CAFCASS here won't see any sense!

one of the violent incidents was even witnessed by my grandson ...

Cathfromsaron - the law is MAD this equal rights is good in some respects but can really muck children about you watch in 20 years they decide that its wrong and what will they do with the kids that they told that its was ok to live half time as both parents have equal responsibilitys my friends children had to take the dad to court and stand in the dock (the ones that where over 10) and say that they did not want to see him and did not want him to have any parental responsibility madness that children had to do this her younger child had to endure weeks of going to a safe house until they courts decided that she was to up set and she does not have to see him now. hope your situation gets sorted soon xx
we are going along with the supervised contact until D is 7 and can say if he doesn't want to go!

but he is affected in certain ways and behaves strangely upon his return!

next morning he is fine for another fortnight!

I don't either! No punctuation ..that is the problem, so you can't read it properly. The way it reads reminds me of a certain 'Little Britain' character.
