So the summons arrives addressed to him. She knows what it is and opens it. She wants to keep it from him for some reason so she says she was driving, whether or not she was, and signs the form in his name and accepts the fine & points. Given they were still together at that time I find that scenario highly unlikely.

Whatever the outcome I expect the public gallery will be packed every day. He will hope the jury is packed with Lib Dem diehards.
