My Father is very elderly with failing health. He owns a 4 bedroom house left to my Brother and myself in his Will. However, my Brothers daughter (21) is homeless at the moment as she was in rented accom with a child and partner but they cannot afford the rent and Council list is a very long wait. They are both a pair of lazy layabouts and will do nothing to help my Father in his home. (He is probably even giving them money). I feel they are trying to make themselves comfortable and are looking to stay there forever. My Brother wont have anything said against them (obviously he sees no wrong). I am a tad peed off with it. Are they entitled to any of the property as tenants if anything should happen to my Father?

i don't think so. Although, of course your dad could easily change his will before he died

Yes. He cannot see that they are a pair of spongers.......
if things continue as they are and your dad dies, you might have trouble getting them out if you want to sell the house
They are dependent on your father and can therefore apply for reasonable provision from his estate. What that is would be up to a court to decide

I doubt if it would be the right to stay in the property rent free - more likely an order it be sold and they receive part of the proceeds

But it will be difficult to get them out, yes

Why are they dependent they both have jobs ?
why can't they rent somewhere then?
id call this taking advantage of a vulnerable person..id have a civilised word with your brother and ask him to ask them to find alternative living arrangements...
Question Author
Yes taking advantage big time. They waste their salaries on stupid things so can't afford to rent privately it's cheaper living with my father as it's free no bills etc. My Brother has space at his house but he doesn't want them at his!
They are spongers and layabouts and yet they both have jobs???
Question Author
Yes expect family to run around for them give them money when they are skint look after their child so they can go clubbing etc etc
The thing is qwerty, it's really only up to your father who he has in his house, likewise who he leaves his money/ property to. I'm not trying to take sides here but it's just something he has to deal with. Only IF he leaves you anything in his will, will you really have any input and as someone else says he might well change it perhaps in their favour if they all get along- it's fairly irrelevant what you or anyone else thinks about them, at the moment it's just your father's opinion that counts..
