i sell things on ebay , have been for a few years , but a week ago i sold items to a guy , everything was checked and packed (lots of items ) a few days later i received an email saying there was something missing (the product was worth £50) .

he won the listing at 99p with only £30 for postage , the other items and the one he said was missing was in the value of £300+ , he wanted his money back and ebay have said he has to return it 1st that was over a week ago and i still haven't got it back .

What i would like to know is can he go to a claim and make me pay him before i receive them , i don't think he had any intentions of paying in the 1t place as i have looked up his address and the 1st line was significantly different to the one on google maps when i put in the postcode , same area but his address did not exist.

I think (not fact) that his intentions were he was hoping i never sent it recorded delivery and he would have said he never received it.

Cherry, I am not accusing you of doing this.

The item I won was over £15 and I don't think that is cheap enough to not chase the post office for.

It may take a while but it does get resolved.
cherry; hope you dont mind me asking but what was it you sold

That's very true , i now don't sell many things from home and the warehouse where i do my orders always use recorded , so everything is left up to them to chase up , only every had one problem and that was an award which stated the size and i got neutral feedback saying i thought it would be bigger ;-)

stuff from home i start at 99p and usually sell for that only reason i don't chase them up for it .
Did you send the item Royal Mail or Parcelforce? If so pop down your local Post Office and get a claim form. I just hope you insured it as for many ways of posting the maximum value of compensation is £41. You must always tell the clerk if an item is worth more.

it's insured my end , but he says he sent it back last thursday , when i asked him to track it using the number he gave me , he just said i sent it last thursday i was quick enough to pay i just want a refund :-(

update i when i checked to see if he had sent the reply it said case was closed and he had been refunded , but i have checked my ebay account and paypal and there is no signs that i have , i was on ebay live chat for about an hour last night then she gave me a number to phone which i spent another hour waiting to be connected , at 1015 a recorded message said they were now closed (closes at 10)
Cherry, you are under no obligation to refund him until you receive the goods back and can check the contents. I am surprised so many people are bad-naming eBay and PayPal - I buy and sell privately all the time, about to make my 1000th transaction, and the only time I've had a really duff experience was when something got broken on the way to the US - and he sent me photos to prove it, so I refunded him straight away. I had one case where the buyer wasn't pleased (although I felt my description was OK) so I just told her to send it back, and refunded her. I've just cancelled a transaction at the buyer's request because she bid in error - you have to be on the ball but I feel I have been lucky if other people are having such a bad time. I certainly wouldn't let the PO off if mail went missing, I have had 2 items go missing in transit and each time the PO has refunded me with the value of the goods (although not the postage which is often more than the value of the item!). I've found eBay really helpful with the few problems I've had.

i haven't , but ebay have somehow and closed the case but money has not came out of my ebay account or paypal as yet so i am quite confused ,ebay know i havent received the items back and the tracking number he gave was a false one why would they refund him?
All I can suggest is that you ask them. They do close cases after a fixed period of time but I would need to look up the relevant pages to be able to give you accurate info.

thank boxtops , i did try that last night think they are as confused as i am probably why she told me to call them , don't think she could actually find the transaction she kept going away and coming back at 10 min intervals lol , i wont be happy if it comes off my account , stopped using ebay after the last time they did that , went to amazon for a while
